§1 Absolute prohibition of use on humans and animals

No statement on this website, on packaging, in marketing materials or in customer communication is intended to diagnose, treat, cure, mitigate or prevent any disease or medical condition, nor to influence the structure or function of the human or animal body.

Any information regarding biological activity, mechanism of action or published scientific findings is provided solely for informational and educational purposes for qualified researchers, and does not constitute medical advice, a recommendation for use, or marketing of a medicinal product.

§3 Buyer eligibility and warranties

By placing an order, the buyer expressly represents, warrants and confirms that:

• they are at least 18 years of age and have full legal capacity;
• they are a qualified researcher, scientist, laboratory technician or representative of a research institution, university, hospital or commercial laboratory;
• they will use the products exclusively for lawful in-vitro laboratory research;
• they possess the professional knowledge, equipment and facilities required to handle, store and dispose of laboratory chemicals safely;
• they will not administer, sell, resell, distribute or otherwise transfer the products to any person for human or animal consumption;
• they will comply with all applicable Czech, EU and international laws and regulations governing the import, handling, use and disposal of laboratory chemicals.

Providing false information in order to obtain the products constitutes a material breach of contract and may constitute a criminal offence under the Czech Criminal Code (Act No. 40/2009 Coll.).

§4 Safety and handling

The products may be hazardous if handled improperly. The buyer is solely responsible for assessing the risks associated with the substance, implementing appropriate safety measures (personal protective equipment, fume hoods, controlled storage), and consulting the relevant Safety Data Sheet (SDS) before use.

Products must be stored, used and disposed of in accordance with applicable health, safety and environmental legislation, including Act No. 350/2011 Coll. on chemical substances and chemical mixtures and Regulation (EC) No 1907/2006 (REACH).

§5 Exclusion of liability

To the maximum extent permitted by Czech law, the seller (info@thearchive-store.eu) excludes all liability for any direct, indirect, incidental, consequential, special or punitive damages, personal injury, illness, death, property damage, regulatory penalties, loss of profit, loss of data or any other loss arising out of or in connection with:

• any use of the products contrary to their intended research purpose, including any human or animal administration;
• improper storage, handling, dilution, reconstitution, mixing or disposal of the products;
• failure of the buyer to comply with applicable laws, safety standards or the buyer's own institutional guidelines;
• any allergic reaction, adverse event or contamination resulting from misuse;
• any reliance on informational content published on this website.

The seller's liability under § 2913 et seq. of the Czech Civil Code (Act No. 89/2012 Coll.) shall in any event be limited to the purchase price actually paid by the buyer for the specific product giving rise to the claim. This limitation does not apply to damage caused intentionally or by gross negligence, nor to harm to a person's natural rights, where Czech law prohibits limitation.

§6 Buyer's indemnity

The buyer agrees to indemnify, defend and hold harmless the seller, its directors, employees, suppliers and partners from and against any and all claims, demands, liabilities, damages, fines and costs (including reasonable legal fees) arising out of or related to (i) the buyer's use, misuse or onward transfer of the products, (ii) any breach by the buyer of the warranties in §3 above, or (iii) any violation by the buyer of applicable law.

§7 Regulatory and export control

The buyer is responsible for verifying that the import, possession and use of the ordered substance is permitted in their jurisdiction. The seller does not ship to countries where the substance is classified as a controlled or prohibited substance. Orders from such jurisdictions will be cancelled and refunded.

§8 No professional advice

Content published on this website (product descriptions, articles, references to scientific literature) is provided "as is" for informational purposes only and does not constitute medical, legal, scientific or professional advice. The seller makes no warranty regarding the accuracy, completeness or fitness for purpose of any such information.

§9 Governing law

This disclaimer is governed by the laws of the Czech Republic. Any disputes arising from or related to it shall be resolved by the competent Czech courts, without prejudice to mandatory consumer-protection rules under Regulation (EU) No 1215/2012.

§10 Acceptance

By accessing this website, placing an order or otherwise using the seller's services, the buyer confirms that they have read, understood and accepted this Disclaimer & Warning in full. If the buyer does not agree, they must leave the website immediately and refrain from ordering.
